Travel Booking Terms & Conditions

The terms and conditions set forth in this Agreement constitute the entire understanding and agreement between you and TravelOnly Inc. operating as Travel By Rosie (collectively referred to as “TravelOnly”) with respect to any and all bookings, tours or transactions made with TravelOnly.

By providing your credit card, signing, or electronically accepting a booking, you accept all of the terms in this Agreement and direct us to perform services on your behalf. All persons named in your booking are subject to this Agreement and you affirm that you have made all other participants listed in the booking aware of these terms – regardless of how final payment is made – and that all participants accept these terms.

Deposits and Payment: A deposit (the “Deposit”) may be required at the time of booking and is non-refundable, unless otherwise specified. By providing your credit card information to TravelOnly to pay for travel services, you are confirming that you will pay the total amount charged according to your cardholder agreement. In addition, you agree not to chargeback your payment.

Future Travel Voucher/Credit: A future travel voucher/credit may be issued at the discretion of the operator/supplier in lieu of a cash refund in circumstances where Travel Services cannot be provided.

Cancellations and Refunds: To cancel your booking, you must submit your request to us in writing by email to rdarosa@travelonly.com. Cancellation fees may apply. No refund will be made for unused travel services or any unused portion of the services. Any changes to your booking are also subject to the terms and conditions of the tour operator, airline, cruise line, hotel or other supplier.

Changes to Bookings: If you change your travel dates or alter your itinerary after we confirm your trip, a change fee may apply. The type and scope of change dictates the amount of the change fee charged by the supplier.

TravelOnly Change and Cancellation Fees: Should you cancel or change your booking prior to departure a change fee of a minimum of $50 per person may be due immediately at time of cancellation through TravelOnly and will be charged to the credit card on file. This fee shall be in additional to any fees charged by the supplier and will be advised to you at the time of booking.

Trip Cancellation: You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary of a trip may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. In the event of a change of schedule, we will notify you of available alternatives as soon as reasonably possible.

Accuracy Of Information: TravelOnly makes every effort to ensure the accuracy of the information contained herein and to the best of its knowledge, all information is accurate at the time of publication and/or booking. We try to ensure that the prices on this website are accurate, however, errors do occur and we reserve the right to refuse to accept and/or the right to cancel and refund any bookings, purchased at any price posted in error. Updates are published on our website when new information is made available, however, TravelOnly cannot be responsible for any inaccuracies or omissions contained herein or for any third party publications or postings. Information contained herein is provided as a guideline only and should be verified directly with other available sources. TravelOnly reserves the right to make changes to these Terms and Conditions at any time, and any changes to these Terms and Conditions will be effective immediately upon being posted on our website.

Responsibility: TravelOnly acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities, insurance or other goods and services connected with your trip. You acknowledge that you are aware and clearly understand that these suppliers are independent contractors, are not managed by TravelOnly and are not agents or employees of TravelOnly. A supplier’s services are subject to the supplier’s own terms and conditions and the local laws and regulations of the relevant country.

Force Majeure: TravelOnly will not be deemed in breach of this Agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this Agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of TravelOnly, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.

If TravelOnly and/or any of its suppliers are affected by Force Majeure, TravelOnly shall be entitled to, and may in its sole discretion, vary or cancel any itinerary or arrangement in relation to the trip.

Travel Insurance: We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you.

Pre-Departure Documentation: It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within twenty four (24) hours of your receipt of those documents.

Passports and Visas: You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. Although destinations may have their own requirements, it is strongly advised that your passport be valid for at least six (6) months after the scheduled date of departure from the last country visited, regardless of the entry requirements of the country. Other required documents may include visas, permits and vaccination certificates. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

Health: Immunizations may be required to gain entry into certain destinations and/or to gain re-entry back into Canada. Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. For information on Canadian requirements regarding provisions on immunizations, passports, visas, etc. please visit www.travel.gc.ca. It is recommended that travelers contact the destination country’s embassy in Canada with further questions before they depart.

Entry and Flight Requirements: Certain things my be required for different destinations. You may be required to wear a mask while at the airport. You may be required to have your temperature checked and/or a blood check performed at the airport. You may be required to show proof of a negative COVID19 test. You may be required to show proof of certain vaccinations such as COVID19, or Yellow Fever, etc. All requirements can change at any time and new terms can be added. This SITE is a good resource to help you determine what is needed, however it is recommended that you always go to the source, i.e. your destination country's website.

Flights and Baggage: We recommend you check the website of your airline for check-in and cut-off times prior to departure for your flight and destination. You should also contact your airline to determine if there is any charge for checked baggage, excess baggage, as well as any weight and carry-on requirements specific to your airline, or your carry-on items could be refused. You should also check what items are permitted in your carry-on luggage. Some advanced seat selection, airport fees, airport transfers, taxes and baggage fees, where applicable, may not be included in the pricing. Advanced seat selection and baggage fees vary depending on the airline(s) you are booking with.

Refusal to Transport/Removal of Customer/Refusal of Entry: The Tour Operator, Airline nor Travel Agency or acting Agent shall be liable for its or another air carrier’s refusal to transport or refusal of entry to the customer(s) arising from the following circumstances: a Customer fails to register for a flight (no show), a Customer jeopardizes public safety, a Customer does not hold the proper travel documents or the latter are invalid, a Customer violates or may violate any applicable law, a customer has a criminal record, if the final payment is not honored, the Staff or air carrier deems it necessary to deny boarding of a Customer in order to prevent any danger or risk to such Customer or to any other person or property, or to ensure the safe conduct of the flight. This section also applies, with the necessary adjustments, to maritime and ground transportation.

Cannabis and Cross Border Travel: Under the Cannabis Act, the legalization of cannabis in Canada will not change Canada’s border rules. Taking cannabis or any product containing cannabis across Canada’s international borders (going or coming home) will remain illegal and can result in serious criminal penalties both at home and abroad. This will be the case even if you are travelling to places that have legalized or decriminalized cannabis. Transporting cannabis used for medical purposes will also remain illegal. Cannabis is illegal in most countries. Previous use of cannabis, or any other substance prohibited by local law, could result in a traveler being denied entry to his or her destination country. Each country or territory decides who can enter or exit through its borders. The Government of Canada cannot intervene on your behalf if you do not meet your destination’s entry or exit requirements. Local Laws and Etiquette: Please be aware that different living standards and practices exist outside of Canada including, but not limited to, provisions of utilities, accommodations, customs and services of all kinds. TravelOnly cannot guarantee the condition of any destination, including safety, health or climate conditions. Indemnification: In consideration of TravelOnly making a booking on your behalf, you agree to indemnify and save harmless TravelOnly, and its employees, agents and assigns, from any and all possible claims, demands, damages, expenses, costs or actions in respect to injury, damage or loss which may result from your booking. You agree that the sole remedy for any default by TravelOnly arising under this Agreement shall be the return of the paid trip cost.

Severability: If any provision of this Agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the Agreement unenforceable or invalid as a whole and the other provisions shall continue to have full force and effect.

Successors and Assigns: This Agreement shall inure to the benefit of and be binding upon the Participant and their respective heirs, legal personal representatives, successors and assigns.

Governing Law: This Agreement shall be governed by the laws of the Province of Ontario and the laws of Canada. You agree and hereby submit to the non-exclusive jurisdiction of the courts of the Province of Ontario with respect to all matters relating to this Agreement.

This section also applies, with the necessary adjustments, to maritime and ground transportation including refusal or denial of entry to your destination due to health or safety concerns. The Customer also is aware that they may be quarantined at destination if advised by the Government, airline or resort/hotel or other governing entities. It remains your responsibility to be aware of the risks related to the spread of infectious or contagious diseases and to take necessary precautions applicable to any health hazards, including but not limited to COVID19. To ensure the safety of all guests and employees, airports, airlines, resorts and service providers may have mandatory safety protocols in place and the availability of some of their services and facilities may be impacted. Many insurance companies consider travel vouchers as compensation for loss of travel and will not provide coverage in the form of a refund.
